An expert report may reach a conclusion that conflicts with your position. A professional review asks where the problem arose and how it affected the result. Reports combine documents, assumptions and a calculation or examination method. Understanding those layers helps produce an objection that can be discussed and checked.

Read the appointment before the conclusion

Review the issues referred to the expert, the documents received and the period examined. A calculation may be accurate within a scope that fails to answer the dispute. The procedural guidelines place technical matters within expertise; legal characterization and liability remain for the court. Correcting a measured quantity therefore differs from deciding contractual entitlement.

Make the objection verifiable

Identify the page, statement or calculation, connect it to a clear document and explain the effect of correction. Examples include an omitted payment, a repeated invoice, an incorrect starting date or an unexplained measurement. Check whether the report addressed material documents and observations submitted to the expert.

Request a remedy suited to the defect

Article 120 of the Evidence Law allows the court to question the expert, require completion or correction, or appoint another expert as appropriate. Explain the requested step: clarification may resolve the source of a figure, whereas an unexamined technical issue may require further work. Obtain specialist assistance when needed, without treating a private report as a judgment.

Understand judicial discretion and its exception

Under Article 121, the expert’s opinion generally does not bind the court, which must explain why it rejects all or part of it. An important exception applies where the parties agreed to accept the report’s result: the court gives effect to that agreement unless it conflicts with public order. Review any earlier agreement and its limits before planning an objection.

Prepare within the deadline

Monitor notices and the dates set for observations, preserve proof of filing and organize the objection so each supporting document can be located. Delay or a general rejection may weaken the benefit of the available procedure.

  • A table linking each error to its document, effect and requested remedy.
  • Proof that observations were filed within the specified deadline.

Fictional example

In a fictional example, an expert calculates a supplier’s balance without deducting a transfer relating to the same invoices. The client supplies the transfer evidence, links it to those invoices and requests correction with an alternative balance. The issue becomes verifiable, while the court retains responsibility for assessing the evidence and its effect.

When the report arrives, request a combined technical and legal review before responding. A useful objection exposes the defect and proposes a clear remedy; the outcome depends on the case file and procedure.
